In a decision rendered today, the Canada Industrial Relations Board (CIRB) declined WestJet’s application for an injunction that would prevent AMFA Aircraft Maintenance Employees from striking. The decision is a critical reaffirmation of union employees’ fundamental rights.
On June 17, WestJet communicated to AMFA that it refused to engage in further bargaining. Instead, it would pursue the compulsory arbitration of contractual terms or, alternatively, force the adoption of a collective bargaining agreement rejected by 97.5% of the employees.
AMFA served its strike notice in direct response to WestJet’s refusal to bargain.
In the immediate aftermath of the CIRB’s decision, WestJet advised that it would reverse its decision and agreed to set bargaining dates. AMFA has now revoked its strike authorization as a result of WestJet’s commitment.
AMFA will not initiate strike action while, in its determination, bargaining remains productive.
Please refrain from any job action as the parties continue bargaining. Our focus will be on negotiating an agreement acceptable to our members.
