Since the Canada Industrial Relations Board (CIRB) issued its May 7, 2025, Interim Order confirming the fragmentation of the former TMOS Unit at Air Canada, the IAMAW has made every attempt to derail the certification process. Its lawyers have filed an application for judicial review of the Board’s Order, obtained a stay from the Federal Court of Appeal prohibiting the release of vote results, and requested that the Board reconsider its original fragmentation decision. At the same time, the IAMAW has removed TechOps representatives from union positions and has ceased to provide any help or assistance to members on the floor. Your dues are being used to finance the IAMAW’s desperate and self-serving legal tactics. Your protections at work have suffered as a result.
Recently, the IAMAW has proclaimed that it will serve a notice to bargain on behalf of the former TMOS Unit as early as January 2026. The Canada Labour Code strictly prohibits any such attempt by the IAMAW. While an application for certification remains pending, no party may seek to change the prevailing terms of employment without the express consent of the Board. Even Air Canada has acknowledged this fact and confirmed that it has no interest in bargaining with the IAMAW.
AMFA is dedicated to enforcing your rights under the Code. It has filed a Request for Immediate Assistance with the Board seeking confirmation that any effort by the IAMAW to force a bargaining process would violate the Code. AMFA’s Request also describes the delay tactics pursued by the IAMAW. In the absence of these tactics, AMFA would already be your certified bargaining agent. Therefore, AMFA has requested that union dues be held in trust by Air Canada until all certification issues are resolved.
