On May 6, 2022, the Aircraft Mechanics Fraternal Association (“AMFA”) filed an application to represent the Spirit Airlines’ (“Spirit”) Mechanics and Related Employees together with signed authorization cards from a substantial majority of Spirit AMTs.  All signed authorizations are treated as confidential by the federal government and are not subject to release.

On May 10, 2022, the National Mediation Board (“NMB”) issued NMB Case No. R-7587 to the application and assigned Investigators Eileen Hennessey and Josie GM Bautista to the case. The NMB also issued a Notice to Employees, which Spirit must post at all stations, advising Spirit AMTs that the airline must not interfere with your right to a free and fair election.

May 24, 2022, was set by the NMB as the deadline for Spirit to provide an alphabetized list of potential eligible voters.  AMFA, with your assistance, has the right to review that list to determine if anyone has been inappropriately included or excluded on the list.  For example, supervisors are not permitted to vote in this election.  

Once the NMB confirms that a majority of craft or class has executed cards, the agency will schedule a secret ballot election – unless Spirit agrees to expedite the proceed by voluntarily recognizing the majority’s will.

The NMB will provide copies of the Notice of Election/Sample Ballot and voting instructions to the participants at least five (5) calendar days before the ballots are mailed. The carrier must post these documents on carrier bulletin boards, physical and electronic, and at all locations where other Notices to employees usually are posted. At least one Notice per work location must be posted.

The tally of votes will occur at the NMB’s Office in Washington, DC on the day set by the agency. If AMFA receives a majority of votes cast, it will be certified as the representative. The NMB will generally issue a Certification based upon the Report of Election Results the next business day following the count.

This is your time as American workers to vote, by secret ballot, in a government-supervised union election.  Spirit AMTs have a right to bargain with the strength that comes with a united voice.  It is time to assert that right.
